Senator Mark Kelly Sues Pentagon Over Free Speech

Democratic Senator Mark Kelly filed a lawsuit against the Pentagon on Monday, alleging that the Trump administration violated his free speech rights by attempting to penalize him for raising concerns about unlawful orders given to U.S. troops. Kelly, a retired astronaut and former U.S. navy pilot representing Arizona, is challenging the recent censure imposed on him by U.S. Defense Secretary Pete Hegseth. Hegseth announced the censure on January 5, stating that it was a procedural step that could lead to a demotion from Kelly’s retired captain rank and a reduction in retirement benefits.

In response, Kelly has taken legal action in a Washington, D.C. federal court, seeking a ruling that the censure letter, rank proceedings, and any other punitive measures against him are unconstitutional and unlawful. His lawsuit argues that the First Amendment protects legislators from retaliation for expressing dissenting views, particularly on matters of public policy.

The Pentagon has not yet commented on the lawsuit, which has been assigned to U.S. District Judge Richard Leon, appointed by former President George W. Bush. This legal challenge by a sitting senator against the defense secretary is unusual and reflects broader efforts by Congress members to check what they perceive as executive overreach.

The censure stemmed from Kelly’s involvement in a video in November 2025, alongside five other Democratic lawmakers who are veterans of the armed forces and intelligence community. In the video, they urged troops to uphold the Constitution and reject unlawful orders. Despite facing scrutiny, Kelly and his colleagues have stood by their message, which drew criticism from former President Donald Trump, who labeled it as seditious.

The Pentagon initiated an investigation into Kelly in late November, citing a law that allows retired service members to be called back to active duty for potential disciplinary action. While all six lawmakers in the video have military or intelligence backgrounds, Kelly is the sole target of the investigation due to his formal military retirement status.

The lawsuit names Hegseth, the Defense Department, Navy Secretary John Phelan, and the Navy as defendants. Kelly emphasized that his legal action is a defense of veterans’ rights and a stand against attempts to silence dissent by threatening their military benefits. He asserted that such actions are contrary to the principles of the United States and vowed to resist them.
