“Scottish Trio to Face Trial in Canada for Restaurateur’s Murder”

Date:

Three individuals accused in relation to the murder of a well-liked restaurateur in Owen Sound, Ontario, have agreed to be extradited from Scotland to face trial in Canada. The accused are Robert Evans, aged 25, who is charged with manslaughter, and his father, Robert Busby Evans, aged 47, and uncle Barry Evans, aged 54, who are charged as accessories after the fact.

According to Robert Currie, a transnational criminal law professor at Dalhousie University, the trio is expected to be transported to Canada soon. The extradition process is anticipated to be expedited without contestation, requiring approval from both Canadian and UK authorities.

The incident involved the death of Sharif Rahman, the owner of Curry House, who passed away in a London, Ontario hospital in August 2023 after being assaulted outside his restaurant while confronting patrons who were attempting to skip payment.

During a court appearance at Edinburgh Sheriff Court, the three men expressed their consent to be transferred to Canada for trial. They acknowledged the irrevocable nature of their decision and agreed to remain in custody in Scotland until extradition. The Canadian authorities have assured that any time spent in Scottish custody awaiting extradition will be considered in their sentencing.

The extradition proceedings, which involve the father, son, and uncle, were agreed upon without resistance. The individuals will be treated as regular criminal defendants upon arrival in Canada and are entitled to support from their respective governments.

The decision to consent to extradition by the accused remains unclear, and no details have been disclosed regarding their motivation. Additionally, it is unknown whether a report on the conditions of Ontario jails, requested by the court, has been submitted.

The accused individuals were identified through a CBC News investigation that uncovered their social media profiles and provided images of the trio. The investigation revealed the roles each played in the incident, with Robert Evans Jr. allegedly throwing the fatal punch, Barry Evans assisting in the aftermath, and Robert Evans Sr. aiding in his son’s escape.

The accused individuals, using fake names, entered Canada as visitors in June 2023 and engaged in various activities throughout the province. The court has not specified a date for their extradition.
