Family Seeks $25M in Damages After Fatal Hwy 401 Collision

A family has initiated legal action against the officers, police board, and the estate of a suspect following a tragic collision on Highway 401 last year, resulting in the loss of three family members. Gokulnath Manivannan and Ashwitha Jawahar, the only survivors of the April 2024 crash, are seeking $25 million in damages in the lawsuit, alleging negligence on the part of the defendants, including police officers from Durham Regional Police and Ontario Provincial Police.

The incident occurred after a police pursuit stemming from an alleged robbery, leading to a fatal collision involving multiple vehicles on Highway 401 in Whitby. The pursuit, which started in Bowmanville, ended in tragedy, claiming the lives of the suspect and the family members. Following an investigation by the Special Investigations Unit, Sgt. Richard Flynn and Const. Brandon Hamilton of Durham police are facing criminal charges in connection with the collision.

The lawsuit asserts that the officers’ decision to engage in the pursuit without considering alternatives was reckless and contributed to the fatalities. The family also accuses Durham police of inadequate training and failure to halt the pursuit. While no statements of defense have been submitted yet, the family continues to endure physical and emotional suffering, incurring substantial medical expenses and loss of income.

Represented by legal counsel, the family hopes that the lawsuit prompts a thorough review of pursuit protocols to prioritize public safety. The tragic event has left lasting impacts on the family, emphasizing the need for accountability and improved standards in law enforcement practices.
