A former Bloc Quebecois MP, who narrowly lost her seat in the April federal election by a single vote, is now seeking a redo of the election results. The legal challenge is taking place over three days in St-Jerome, Que., specifically focusing on the riding of Terrebonne, located north of Montreal.
The challenge arose after a local resident, who claimed to have voted for the Bloc, discovered that her special ballot was rejected due to an address error on the Elections Canada-provided envelope.
During the election, incumbent MP Sinclair-Desgagné was defeated by Liberal candidate Tatiana Auguste by just one vote. Sinclair-Desgagné‘s lawyer, Stephane Chatigny, argues that the voter’s rights under the Charter were breached by the uncounted ballot and insists on a fresh election in the constituency.
Chatigny further points out that 16 other special ballots were also not returned on time, suggesting that additional voters might have been impacted by similar issues.
