Hong Kong’s ex-media mogul Jimmy Lai, known for his pro-democracy stance and criticism of Beijing, has been handed a 20-year prison sentence in a significant legal action under China’s imposed national security law, which has stifled dissent in the city. Judge Esther Toh ruled that 18 years of Lai’s sentence must be served consecutively with his existing fraud-related jail term of five years and nine months. Lai retains the right to appeal the decision.
In the same case, six former employees of Lai’s Apple Daily newspaper and two activists were also convicted, receiving prison sentences ranging from 6¼ to 10 years for charges related to collusion. Despite facing charges of conspiring with others to collaborate with foreign entities to jeopardize national security and plotting to publish seditious content, Lai, at 78 years old, was not given the maximum life imprisonment penalty by the three judges overseeing the case.
Lai’s conviction in December means the prison term, considering his age, may effectively be a life sentence. The sentencing of Lai has sparked international criticism and could escalate diplomatic tensions between Beijing and other nations. U.S. Secretary of State Marco Rubio has called for Lai’s release on humanitarian grounds, condemning Beijing’s efforts to suppress advocates of basic freedoms in Hong Kong. Similarly, Canadian Foreign Affairs Minister Anita Anand expressed disappointment with the outcome and urged for Lai’s release, emphasizing Canada’s support for independent media globally.
Robert Pang, one of Lai’s legal representatives, highlighted his client’s health issues, including heart problems and diabetes. Lai’s son, Sebastien, described the lengthy prison term as devastating and life-threatening for his father, criticizing the impact on their family and denouncing the erosion of justice in Hong Kong. Despite the grim situation, Sebastien emphasized that his father’s spirit remains unbroken, recalling Lai’s stoic response and subtle defiance during the sentencing.
The trial and imprisonment of Lai have drawn attention to the diminishing press freedom in Hong Kong, once a beacon of independent media in Asia. The government insists that the case is not about press freedom but rather about individuals misusing journalism as a cover to harm China and Hong Kong. Lai’s arrest under the security law in 2020 marked a significant event, followed by the subsequent arrest of senior journalists at Apple Daily, leading to the newspaper’s closure in June 2021.
International condemnation of Lai’s sentencing has been widespread, with various political figures and organizations criticizing the decision as a violation of freedom of expression. The Inter-Parliamentary Alliance on China and the European Union have called for coordinated diplomatic efforts in response to Beijing’s actions in Hong Kong. Amnesty International labeled the sentence as a disregard for human rights, emphasizing the need for Lai’s immediate release. Meanwhile, China’s Foreign Ministry has defended the judicial proceedings as Hong Kong’s internal affairs, urging other nations to refrain from interference.
