A cluster of Vancouver tenants is pushing back against eviction threats they received for their involvement in a private Facebook group dedicated to tenants. Residents at The Yarrow apartment complex on Kootenay Street in East Vancouver reported finding warning notices attached to their unit doors last month by Realstar Group, the property’s owner and manager.
The notices, prominently labeled “WARNING BREACH OF TENANCY AGREEMENT,” addressed the recipients’ participation in the Yarrow Residential Hub Facebook group. Alleging that sharing private conversations and encouraging complaints breached the tenancy agreement and Residential Tenancy Act, the company warned residents against repeating such actions, hinting at eviction consequences.
Realstar Group, a Toronto-based real estate investment and management firm with substantial assets, issued the warning letters to residents, causing distress among some tenants, including concerns over privacy violations. Despite declining recorded interviews, three tenants shared their apprehensions with CBC News.
In response to the situation, a group of ten residents, branding themselves as Concerned Tenants of The Yarrow, penned a rebuttal denouncing the accusations made in the letters. They urged Realstar Group to cease sending threatening emails in response to service requests and to refrain from monitoring tenant communications.
Expressing skepticism regarding the eviction grounds under the Residential Tenancy Act (RTA), Robert Patterson from the Tenant Resource and Advisory Centre (TRAC) highlighted the absence of legal restrictions on tenants’ communication or collaboration. Realstar later issued an apology to residents, retracting their eviction threats and acknowledging tenants’ rights to communicate and share experiences.
The incident has drawn attention to the growing trend of landlords accusing tenants of libel, with instances such as a past lawsuit filed by a Vancouver landlord against tenants for defamation. Experts advise tenants to ensure factual accuracy in their communications to safeguard against legal repercussions.
Tenants are encouraged to unite and communicate to address issues collectively, reinforcing their position and rights against potential retaliatory actions from landlords.
